1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer" or "you") and Benify Exteriors ("Company," "we," "us," or "our"), governing your use of our website and any services we provide, including roofing, siding, gutter, and solar installation and repair.

These Terms apply in addition to any written contract or service agreement signed between you and Benify Exteriors for a specific project.

2. Our Services

Benify Exteriors provides exterior home improvement services including, but not limited to:

• Roof installation, replacement, and repair
• Gutter installation, repair, and gutter guard systems
• Siding installation and repair (vinyl, fiber cement, engineered wood, insulated)
• Solar panel installation
• Storm damage assessment and restoration
• Free property inspections and written estimates

All services are subject to a written scope of work agreed upon before the project begins. Benify Exteriors reserves the right to decline any project at our discretion.

We serve residential and commercial properties. Service availability may vary by location — contact us to confirm coverage in your area.

3. Estimates & Quotes

All estimates provided by Benify Exteriors are free of charge and carry no obligation. A written estimate outlines the proposed scope of work, materials, timeline, and pricing based on the information available at the time of inspection.

• Estimates are valid for 30 days from the date of issue unless otherwise stated
• Final pricing may change if unforeseen conditions are discovered once work begins (e.g., hidden structural damage, rotted decking, or code-required upgrades)
• Any changes to the scope of work or materials after project commencement will be documented in a written change order and require your approval before proceeding
• Verbal agreements are not binding — only written, signed estimates and contracts constitute our commitment to a price

4. Payments & Billing

Payment terms are outlined in your project contract. Standard terms include:

• A deposit may be required prior to ordering materials or scheduling your project start date
• Final payment is due upon project completion unless otherwise agreed in writing
• Accepted payment methods include check, credit card, and bank transfer — as specified in your contract
• Late payments may be subject to a finance charge as permitted by applicable law
• For insurance claims, payment terms will align with the insurance settlement process — we work with you throughout

Any disputes regarding invoices must be raised in writing within 10 days of the invoice date. Failure to dispute within this period constitutes acceptance of the charges.

5. Scheduling & Property Access

By scheduling a project with Benify Exteriors, you agree to the following:

• You authorize our crew and subcontractors to access your property to perform the agreed scope of work
• You will ensure clear access to the work area on the scheduled start date, including removing vehicles, outdoor furniture, or other obstacles as needed
• Benify Exteriors may reschedule projects due to weather conditions, material delays, or other circumstances beyond our control — we will notify you promptly
• Cancellations by the customer must be made at least 48 hours before the scheduled start date; late cancellations may result in a fee to cover mobilization costs
• You are responsible for notifying any HOA, property management, or local authority of the planned work if required

6. Warranty

Benify Exteriors stands behind the quality of our work. All major installations are backed by a workmanship warranty covering defects in installation quality for the period specified in your project contract.

• Workmanship warranties cover issues resulting from improper installation by our crew
• Material warranties are provided separately by the manufacturer and are subject to the manufacturer's own terms and conditions
• Warranties are non-transferable unless otherwise agreed in writing
• Warranty claims are void if damage results from acts of nature, misuse, unauthorized modifications, or failure to maintain the property

7. Limitation of Liability

Benify Exteriors carries full general liability insurance and workers' compensation coverage on all projects. However, our liability is subject to the following limitations:

• Our total liability for any claim arising from our services shall not exceed the amount paid for the specific project giving rise to the claim
• We are not liable for indirect, incidental, consequential, or punitive damages of any kind
• We are not responsible for pre-existing conditions, hidden defects, or damage caused by factors outside our control (storms, structural failures, third-party actions)
• Benify Exteriors is not liable for damage to landscaping, driveways, or underground utilities that are not clearly marked or disclosed prior to project commencement

Nothing in these Terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

8. Website Use

By using our website, you agree to the following conditions:

• You will use the website only for lawful purposes and in a manner that does not infringe the rights of others
• You will not attempt to gain unauthorized access to any part of our website or its underlying systems
• You will not use automated tools (bots, scrapers) to access or collect information from our website without written permission
• You will not submit false, misleading, or fraudulent information through our forms or communications
• We reserve the right to restrict or terminate access to our website for any user who violates these terms

• Project photos taken by Benify Exteriors on your property may be used in our portfolio, website, and marketing materials unless you opt out in writing prior to project completion
• Customer reviews submitted to us may be displayed on our website and marketing materials

10. Disputes & Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

• In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation
• If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree otherwise in writing
• You waive the right to participate in class action lawsuits against Benify Exteriors to the extent permitted by law
• Any legal action not subject to arbitration shall be brought exclusively in the courts of Maryland
